RAPPORT FINANCIAL SERVICES Inc. TERMS AND CONDITIONS OF SERVICE
The client(s) engages the services of Rapport Financial Services Inc, under the below mentioned terms and conditions:
1) Client(s) Commitments & Terms: All clients/customers/former and past clients, agree to forward all correspondence from the credit bureaus to Rapport Financial Services Inc , but not limited to, letters and credit reports.
Rapport Financial Services Inc, cannot perform the service provided without obtaining copies of the credit reports and all correspondence from the credit bureaus. Clients agree to provide all relevant and requested documents in a timely manner. We ask that all documentation be provided as soon as reasonably possible.
Clients agree to inform Rapport Financial Services Inc of any change of address in a timely manner. Rapport Financial Services Inc will be limited in providing our services without obtaining new bills/statements with the newly reflected address.
Clients understand that Rapport Financial Services Inc has no ability to dictate the decisions clients make regarding financial decisions that may impact their credit report, credit score, and/or other financial responsibility(s). Clients cannot and will not hold Rapport Financial Services Inc accountable or liable for any actions , and/or consequences regarding their past, present, and/or future decisions that may impact their credit report, credit score, financial situation, and/or standing(s) with any financial, or otherwise, institution and/or company.
ABOUT THE TERMS
This service is provided by Rapport Financial Services Inc. If a client chooses not to upload and follow the terms of this Service terms, you may not use the Service. We hold the right to modify and our change the service terms at any time.
If you does not agree to the changes made, you must discontinue using the Service, discontinue using Rapport’s services, rescind your request that Rapport contact you about its credit improvement services, and discontinue your activity in Rapport’s Services and Programs before your account and or access is discontinued
Your continued use of Rapport service, request that Rapport contact you about its credit repair services, and/or participation in Rapport’s Services and Programs after any such changes take effect constitutes your acceptance to such changes.
Each time you visit or log into Rapport’s services; continue using Rapport as a means to contact on the basis of your credit repair improvement, and/or participate in Rapport’s Services and Programs, you reaffirm your acceptance of the current Terms of Service.
You the client are responsible for regularly reviewing the Service Terms, by clicking on the “Terms of Service” link at www.tryrapport.com/terms-of-service/ The Terms of Service may be supplemented by additional terms and conditions applicable to privacy, specific areas of this Service, or to where particular content or transactions are posted in particular areas of the Service and, together with the Terms of Service, govern your use of those areas, content, or transactions.
This service and website provide users with information about Rapport credit improvement services, general educational and informational resources about credit, and the ability to sign up for and engage Rapport’s services.
The Website contains information, content or advertisements text, photographs, designs, graphics, images, sound and video recordings, animation and other materials and effects (collectively, the “Content”) that are protected by copyrights, trademarks, service marks, trade dress, patents or other intellectual or proprietary rights owned by Rapport Financial Services Inc. or other third parties. All trademarks and copyrighted information contained on the Website are the property of their respective owners. Further, Rapport Financial Services Inc retains all rights (including intellectual property rights), title and interest in the Website, technology, and all underlying technology and data including any enhancements, software, applications and improvements related to the Website (the “Technology”)(the terms Content and Technology collectively will be referred to as the “Materials”). You may not remove from any electronic or printed copy any copyright, trademark, or other proprietary notice.
Clients agree to pay Rapport Financial Services Inc for the services rendered. Lack of payment will suspend all work on their account. Rapport Financial Services Inc will work with any customer’s seeking to resolve billing or service issues so long as that customer contacts our office as soon as reasonably possible regarding their billing or accounting issue(s).
The success of this service will be dependent on the completion of the above mentioned client(s) commitments. Clients understand that failure to compete all of these activities will void the service guarantee, refund, and warranty.
Clients are aware that Rapport Financial Services Inc offers a monthly plan. If a client selects the monthly plan, he/she can cancel his/her service at any time. He/she must only provide a 30 day notice in advance. He/she understand that he/she will be billed 1 additional monthly charge after electing to cancel his/her services.
3) Payment Structure: Clients agree to pay Rapport Financial Services Inc for work as it is completed on a month-to-month basis as noted. Payment is due after any work on a client’s account. If the bank returns the payment dishonored, continued work on this account will be closed if your payments are not received according to your contract.
USE OF WEBSITE AND MATERIALS
Rapport provides the Website and the Materials for your individual, non-commercial use and solely for the purpose of carrying out individual transactions with the Website. Any other use of the Website or the Materials is strictly prohibited. You may not, either directly or indirectly:
- Modify, republish, redistribute, delete, resell, sublicense, publicly perform, cache by proxy the Website or Materials without the express written permission of Rapport or the applicable rights holder;
- Use the Materials for telemarketing, direct marketing, and commercial mass e-mail or by agents or representatives or e-mail spammers;
- Reverse engineer, decompile, disassemble, merge, copy, use, disclose, rent, lease, loan, sell, sublicense or transfer the underlying source code or structure or sequence of the Technology or delete or alter author attributes or copyright notices;
- Use any network monitoring or discovery software to determine Website architecture, or extract information about usage or users;
- Reformat or frame any portion of the Website or Materials;
- Use any device, software or routine that interferes with the proper working of the Website, or otherwise attempt to interfere with the proper working of the Website;
- Take any action that imposes, or may impose in our sole discretion an unreasonable or disproportionately large load on our infrastructure;
- Attempt to gain unauthorized access to other computer systems;
- Violate the Website Terms, applicable law or the rights of others; or disrupt or interfere with the security of, or otherwise cause harm to, the Website.
- Any permitted use of the Website does not extend to using the Website or Materials for any illegal purpose, or to transmit to or through the Website or to or through any service any illegal, harmful, threatening, defamatory, obscene, hateful, pornographic or other objectionable material of any kind, or to interfere with, abuse or otherwise violate the legal rights of any third party using the Website or Materials.
Without limiting other remedies, we may limit, suspend, or terminate our service and user accounts, prohibit access to our website, remove hosted content, and take technical and legal steps to keep users off the Website if we think that they are creating problems, possible legal liabilities, or acting inconsistently with the letter or spirit of our policies. We also reserve the right to cancel unconfirmed accounts.
By using the Website, uploading content to or submitting any materials for use on the Website, you grant (or warrant that the owner of such rights has expressly granted) Rapport a perpetual, royalty-free, irrevocable, non-exclusive right and license to use, reproduce, modify, adapt, publish, translate, create derivative works from and distribute such materials and/or information generated through use of the Website or incorporate such materials and/or information generated through use of the Website into any form, medium, or technology now known or later developed throughout the universe. We need these rights to host and display your content.
Anonymous, aggregate information that does not contain personally identifiable information, comprising account information, or other available data that is collected through your use of the Website, may be used or licensed by Rapport for various purposes including but not limited to conducting certain analytical research, performance tracking, benchmarking, helping to improve products and services and to assist in troubleshooting and technical support.
The Website may use robot exclusion methods, which include robots.txt files and HTML meta tags, which expressly allow and/or exclude specified automated programs from accessing certain portions of the Website. Much of the information on the Website is updated on a real-time basis and is proprietary or is licensed to Rapport by our users or third parties. You agree that you will not use any robot, spider, scraper or other automated means to access the Website for any purpose, including but not limited to performing “offline” searches and mirroring, without our express written permission as indicated in the then current robots.txt file or HTML meta tags on the Website. Additionally, you agree that you will not bypass our robot exclusion methods or other measures we may use to prevent or restrict access to the Website.
You represent and warrant to us that (a) you are legally capable to enter into contracts, (b) you are providing us at all times true, accurate and up to date information about yourself, (c) you will comply at all times with the Website Terms and applicable law and (d) your use of the Website and any transactions that you make with us will not violate the rights of any third party.
Rapport’s services and Website, the underlying information, software, and technology are subject to U.S. export controls. None of the Website services or content may be downloaded, or otherwise exported or re-exported (i) into (or to a national or resident of) Cuba, North Korea, Iran, Sudan, Syria or any other country subject to U.S. sanctions applicable to the export or re-export of goods, (ii) to anyone on the U.S. Treasury Department’s List of Specially Designated Nationals and Blocked Persons List, or the U.S. Commerce Department’s Denied Persons List, Unverified List, Entity List or Nonproliferation Sanctions List. By using Rapport’s services and Website, you agree to the foregoing and you represent and warrant that you are not located in, under the control of, or a national or resident of any such country or on any such list, and that you acknowledge you are responsible to obtain any necessary U.S. government authorization to ensure compliance with U.S. law.
There are several limits to the work of Rapport Financial Services Inc which the client(s) should be aware. Because each case can vary, Rapport Financial Services Inc CANNOT AND WILL NOT GUARANTEE ANY SPECIFIC OR INDIVIDUAL RESULTS ON A CLIENT’S CASE. BECAUSE EACH CASE IS DIFFERENT, THERE IS NO PRECISE TIME FRAME THAT CAN BE REASONABLY DISCLOSED. CREDIT BUREAU REPORTS AS WELL AS OTHER RELEVANT DOCUMENTATION PROVIDED US BECOMES PROPERTY OF RAPPORT FINANCIAL SERVICES INC. A CLIENT AGREE TO WAIVE ALL RIGHTS TO OBTAIN COPIES OF THE CORRESPONDENCE SENT TO THE CREDIT BUREAUS FROM RAPPORT FINANCIAL SERVICES INC.
DEROGATORY INFORMATION REPORTING
The client(s) would like Rapport Financial Services Inc to dispute all information found on the clients credit report that could indicate misleading information except for the information disclosed to Rapport Financial Services Inc separately. Rapport Financial Services Inc will consider any information that is not disclosed to be inaccurate, unverifiable, or obsolete.
Rapport makes no representations regarding the availability and performance of its Online Website. You hereby acknowledge that any use of the Online Website and reliance upon any Materials shall be at your sole risk and that Rapport shall not be liable for any loss of data, lost profits or any other damages or losses resulting from such use.
THE ONLINE WEBSITE AND MATERIALS ARE PROVIDED BY RAPPORT ON AN “AS IS” BASIS AND AS AVAILABLE, WITHOUT ANY WARRANTY OR REPRESENTATION OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY OR OTHERWISE. RAPPORT EXPRESSLY DISCLAIMS ANY AND ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, ACCURACY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT AND THE IMPLIED CONDITIONS OF SATISFACTORY QUALITY AND ACCEPTANCE AS WELL AS ANY LOCAL JURISDICTIONAL ANALOGUES TO THE ABOVE AND OTHER IMPLIED OR STATUTORY WARRANTIES. WE MAKE NO REPRESENTATIONS THAT THE ONLINE WEBSITE OR MATERIALS WILL MEET YOUR REQUIREMENTS, OR THE RESULTS THAT YOU MAY GAIN FROM YOUR USE OF THE ONLINE WEBSITE.
IN NO EVENT SHALL RAPPORT, ITS DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS OR CONTRACTORS BE LIABLE FOR ANY COMPENSATORY, DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, LOSS OF DATA, INCOME OR PROFIT, LOSS OF OR DAMAGE TO PROPERTY, OR ANY CLAIMS OF YOU OR OTHER THIRD PARTIES WHATSOEVER WITH RESPECT TO THE ONLINE WEBSITE OR THE MATERIALS REGARDLESS OF THE LEGAL THEORY ON WHICH THE CLAIM IS BASED, INCLUDING, WITHOUT LIMITATION, ANY DAMAGES THAT RESULT FROM ANY MISTAKE, OMISSION, VIRUS, DELAY OR INTERRUPTION IN OPERATION OR SERVICE OR FAILURE OF PERFORMANCE, WHETHER OR NOT RESULTING FROM AN ACT OF GOD, COMMUNICATIONS FAILURE, THEFT OR OTHERWISE. RAPPORT SHALL NOT BE LIABLE FOR ANY LOSSES OR DAMAGES WHATSOEVER RESULTING FROM ANY FAILURE OF THE INTERNET.
RAPPORT DOES NOT GUARANTEE THAT ANY CONTENT, INFORMATION, SOFTWARE OR OTHER MATERIAL ACCESSIBLE THROUGH THE ONLINE WEBSITE WILL BE FREE OF VIRUSES, “WORMS”, “TROJAN HORSES”, OR THEIR HARMFUL COMPONENTS. RAPPORT’S ENTIRE LIABILITY AND YOUR SOLE AND EXCLUSIVE REMEDY WITH RESPECT TO THE USE OF ANY SERVICES PROVIDED BY RAPPORT SHALL BE CANCELLATION OF YOUR ACCOUNT.
OUR RIGHT TO SUSPEND OR TERMINATE SERVICES
We can, without notice, suspend or terminate any Service at any time for any reason. For example, we can suspend or terminate any Service for the following: (a) late payment; (b) denied payment transaction;(harassing/threatening/abusing/offending our employees or agents; (d) providing false or inaccurate information; (e) interfering with our operations; (f) using/suspicion of using Services in any manner restricted by or inconsistent with the Agreement and Policies; (g) breaching, failing to follow, or abusing the Agreement or Policies; (h) providing false, inaccurate, dated, or unverifiable identification or credit information or becoming insolvent or bankrupt. 8) Arbitration & Mediation: In the event a dispute shall arise between the parties to this contract, agreement, and/or services, it is hereby agreed that the dispute shall be resolved by arbitration in accordance with the applicable United States Arbitration and Mediation Rules of Arbitration. The arbitrator’s decision shall be final and legally binding and judgment may be entered thereon. Each party shall be responsible for its share of the arbitration fees in accordance with the applicable Rules of Arbitration. In the event a party fails to proceed with arbitration, unsuccessfully challenges the arbitrator’s award, or fails to comply with the arbitrator’s award, the other party is entitled to costs of suit, including a reasonable attorney’s fee for having to compel arbitration or defend or enforce the award. (a) “Disputes” are any claims or controversies against each other related in any way to or arising out of in any way our Services or the Agreement, including, but not limited to, billing services and practices, policies, contract practices (including enforceability), service claims, privacy, or advertising, even if it arises after Services have terminated. Disputes include claims that you bring against our employees, agents, affiliates, or other representatives or that we bring against you. It also includes but is not limited to claims related in any way to or arising out of in any way any aspect of the relationship between us, whether based in contract, tort, statute, fraud, misrepresentation, or any other legal theory. (b) If either of us wants to initiate a claim to arbitrate a Dispute, we each agree to send written notice to the other providing a description of the dispute, a description of previous efforts to resolve the dispute, all relevant documents and supporting information, and the proposed resolution. Notice to you will be sent as described in the “Providing Notice to Each Other Under The Agreement” section and notice to us will be sent to: Rapport Financial Services Inc. We each agree to make attempts to resolve the dispute prior to filing a claim for arbitration. If we cannot resolve the dispute within forty-five (45) days of receipt of the notice to arbitrate, then we each may submit the dispute to formal arbitration (c) Unless we each agree otherwise, the Arbitration will be conducted by a single, neutral arbitrator and will take place in the county of the last billing address of the Service (d) The arbitration will be governed and conducted by a neutral third party arbitrator selected by each of us and based upon rules mutually agreed to by each of us.(e) WE EACH AGREE THAT WE WILL ONLY PURSUE ARBITRATION ON AN INDIVIDUAL BASIS AND WILL NOT PURSUE ARBITRATION ON A CLASS-WIDE OR CONSOLIDATED BASIS. We each agree that any arbitration will be solely between you and Rapport Financial Services Inc (not brought on behalf of or together with another individual’s claim). If for any reason any court or arbitrator holds that this restriction is unconscionable or unenforceable, then our agreement to arbitrate doesn’t apply and the dispute must be brought in court.(f) We each are responsible for our respective costs relating to counsel, experts, and witnesses, as well as any other costs relating to arbitration. However, we will pay for the arbitration administrative or filing fees, including the arbitrator fees. Exceptions To Our Agreement To Arbitrate Disputes: Either of us may bring qualifying claims in small claims court. In addition, this arbitration provision does not prevent you from bringing your dispute to the attention of any federal, state, or local government agency that can, if the law allows, seek relief against us on your behalf.No Class Actions: TO THE EXTENT ALLOWED BY LAW, WE EACH WAIVE ANY RIGHT TO PURSUE DISPUTES ON A CLASS WIDE BASIS; THAT IS, TO EITHER JOIN A CLAIM WITH THE CLAIM OF ANY OTHER PERSON OR ENTITY OR ASSERT A CLAIM IN A REPRESENTATIVE CAPACITY ON BEHALF OF ANYONE ELSE IN ANY LAWSUIT, ARBITRATION, OR OTHER PROCEEDING. No Trial By Jury: TO THE EXTENT ALLOWED BY LAW, WE EACH WAIVE ANY RIGHT TO TRIAL BY JURY IN ANY LAWSUIT, ARBITRATION, OR OTHER PROCEEDING.
Indemnification: You agree to indemnify, defend, and hold Rapport Financial Services Inc and our subsidiaries, affiliates, parent companies harmless from any claims arising out of or relating to your actions, including, but not limited to, your use of the Service and any information you submit, post, transmit, or make available; failure to safeguard your information, or other account information; or violating this Agreement or any policy referenced in this Agreement, any applicable law or regulation, or the rights of any third party.
